Terms of Service

By accessing or using Grasslytics (the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, you must discontinue use of the Service immediately. The Service is operated by Grasslytics ("we," "us," or "our").

Grasslytics is an AI-powered lawn care planning and diagnostic platform. The Service provides lawn health analysis from user-uploaded photographs, personalized care plans based on geographic and botanical data, seasonal task scheduling, soil test interpretation, product recommendations, weather-integrated planning, and AI-powered expert guidance.

The Service uses artificial intelligence to analyze lawn conditions and generate recommendations. While we employ professionally-informed AI models and strive for high accuracy, AI-generated diagnoses and recommendations are provided for informational purposes only and should not be relied upon as a substitute for licensed agronomic, horticultural, or professional lawn care advice.

Results may vary based on image quality, lighting conditions, the complexity of the condition presented, and inherent limitations of AI image analysis. We do not guarantee specific outcomes from following the recommendations provided by the Service.

You must create an account to access most features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary to keep it accurate.

You must be at least thirteen (13) years of age to create an account. If you are between the ages of 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We reserve the right to terminate accounts that we reasonably believe to be operated by individuals under the age of 13.

Grasslytics offers two service tiers: a free tier ("Starter") and a paid subscription tier ("Pro") at $9.99 per month or $89.00 per year. The Starter tier includes up to three (3) AI lawn scans per calendar month, basic monthly care plans, and weather alerts. The Pro tier includes up to fifteen (15) AI scans per calendar month, comprehensive personalized plans, AI progress tracking, soil test interpretation, personalized product recommendations with quantity calculations, full progress history, and unlimited expert chat access.

Pro subscriptions are billed in advance on a recurring monthly or annual basis through our payment processor, Stripe. All fees are stated in United States dollars (USD). You authorize us to charge the payment method on file at the beginning of each billing cycle.

Cancellation. You may cancel your Pro subscription at any time through your account settings. Upon cancellation, you will retain access to Pro features through the end of your current paid billing period. After that period expires, your account will revert to the Starter tier. Your data, including scan history, journal entries, and soil test results, will be preserved regardless of plan status.

Refund Policy. Because the Service provides immediate access to AI-powered analysis and personalized data upon each use, we do not offer refunds for partially used billing periods. If you cancel on day 5 of a monthly billing cycle, you retain access for the remaining 25 days but are not entitled to a prorated refund. Annual subscribers who cancel will retain access through the end of their annual term. Exceptions to this policy may be considered on a case-by-case basis for documented technical failures that prevented use of the Service. Refund requests must be submitted within fourteen (14) days of the charge in question through our contact page.

We reserve the right to modify pricing with thirty (30) days advance notice to existing subscribers. Pricing changes will take effect at the beginning of the next billing cycle following the notice period.

You agree not to: (a) upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable; (b) attempt to gain unauthorized access to the Service, other user accounts, or our underlying systems and infrastructure; (c) use the Service for any commercial purpose other than managing your own residential lawn care, without prior written consent; (d) use automated tools, bots, or scripts to access the Service; (e) reverse-engineer, decompile, or attempt to extract the source code of the Service; or (f) circumvent any rate limits, access controls, or usage restrictions implemented by the Service.

You retain full ownership of all photographs and content you upload to the Service. By uploading content, you grant us a limited, non-exclusive, revocable license to process, analyze, and store that content solely for the purpose of providing the Service to you. We do not use your uploaded content to train AI models or for any purpose unrelated to delivering your personalized lawn care analysis.

The Service, including its design, features, source code, algorithms, and content (excluding user-uploaded content), is owned by Grasslytics and protected by copyright, trademark, and other applicable intellectual property laws of the United States and international jurisdictions.

The AI-generated analyses, care plans, product recommendations, and expert responses provided to you through the Service are licensed for your personal, non-commercial use only. You may not redistribute, resell, or publicly display AI-generated content from the Service without our written consent.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: (a) AI-generated diagnoses will be accurate, complete, or suitable for your specific situation; (b) the Service will be available without interruption; (c) following recommendations provided by the Service will produce specific results for your lawn. Lawn care outcomes depend on numerous variables including soil composition, microclimate conditions, water quality, maintenance history, and factors beyond the scope of photographic analysis.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LAWNLYTIC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO DAMAGE TO YOUR LAWN, GARDEN, LANDSCAPE, OR PROPERTY RESULTING FROM FOLLOWING RECOMMENDATIONS PROVIDED BY THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

You agree to indemnify, defend, and hold harmless Grasslytics and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you upload to the Service.

We may suspend or terminate your account at any time for violation of these Terms, with or without prior notice, at our sole discretion. Upon termination, your right to use the Service ceases immediately. We will delete your account data within thirty (30) calendar days of termination unless retention is required by law.

You may delete your account at any time through your account settings. Account deletion is permanent and cannot be reversed.

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising from or related to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, the dispute shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted in Prince William County, Virginia. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page, updating the "Last updated" date, and, for material changes, notifying active users via email. Your continued use of the Service after any modification constitutes acceptance of the revised Terms.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. These Terms constitute the entire agreement between you and Grasslytics regarding the use of the Service.
